1) Acceptance of These Terms

By accessing or using the Site, creating an account, or purchasing any products, you agree to these Terms and the incorporated policies listed above. If you don’t agree, do not use the Site. You may use the Site only if you are at least 18 (or the age of majority in your jurisdiction) and can form a binding contract.

2) Changes to the Terms

We may update these Terms at any time. If we make material changes, we’ll post the updated Terms and revise the Effective Date. Continued use means you accept the updated Terms.

3) Accounts & Security

• Keep your login credentials confidential; you’re responsible for activity on your account.
• Provide accurate information and keep it current.
• We may refuse service, terminate accounts, or cancel orders for suspected fraud, abuse, or unlawful activity.
• Report unauthorized access to admin@thenecklife.com immediately.

4) Product Listings, Pricing & Availability

• Descriptions, images, specifications, and availability may contain minor errors or variances. We strive for accuracy but cannot guarantee error-free content.
• Prices are in USD unless noted and may change without notice.
• If a product is listed incorrectly (e.g., price or info), we may cancel or refuse orders. Paid amounts for canceled orders will be refunded promptly.

5) Orders; Acceptance; Cancellations

• Your order is an offer to buy; acceptance occurs when we (or our supplier) ship the item(s) or otherwise confirm acceptance.
• We may reject/cancel for lawful reasons (fraud flags, inventory, shipping limits, sanctions).
• You may cancel only as permitted in our Return & Refund Policy or any stated order-cancellation window.

6) Payment; Taxes

• You authorize the full charge (products, shipping, taxes, fees) at checkout unless stated otherwise.
• You’re responsible for applicable sales/use/VAT/GST, duties, and fees. Displayed tax may be an estimate.
• Payments are processed by third-party processors; their terms and privacy notices also apply.

7) Dropshipping; Title; Risk of Loss

• We may fulfill via third-party suppliers shipping directly to you. Multi-item orders can ship separately.
• Title and risk of loss pass when the carrier accepts the shipment.
• Transit timeframes are estimates—not guarantees—and can be affected by factors outside our control.

8) Shipping; Delivery; International

• See our Shipping Policy for methods, timeframes, fees, tracking, and delivery issues.
• International buyers are responsible for customs, brokerage, duties, and taxes. We aren’t responsible for customs delays or import denials.
• If tracking shows “delivered” but you didn’t receive it, follow the steps in our Shipping Policy. We’ll reasonably assist but are not the shipment insurer.

9) Returns, Refunds & Exchanges

• Our Return & Refund Policy governs eligibility, windows, non-returnable items, and restocking fees (if any). EU/UK consumers: see the EU/UK Addendum where applicable.
• Items generally must be returned in original condition/packaging unless otherwise allowed.
• Refunds are typically issued to the original payment method after inspection/approval per policy.

10) Promotions, Gift Cards & Coupons

• Promotions and coupons may have separate terms; we can modify or end them at any time.
• Unless stated, promotions can’t be combined, have no cash value, and are non-transferable. See Promotions & Discounts Policy.

11) Subscriptions & Auto-Renewals (If Offered)

• Specific subscription terms apply at sign-up and are incorporated here.
• Auto-renewal: Renews automatically at the then-current rate unless you cancel before the renewal date. Manage in your account or email admin@thenecklife.com.

12) Health, Safety & Use at Your Own Risk

• No medical/professional advice. Site content is informational only. Consult a qualified professional before using products affecting health, posture, or physical condition.
• Follow all labels/manuals. Improper use can cause injury or damage. You assume all risks from product use.

13) Intellectual Property

• The Site and its content are owned by The Neck Life, LLC or licensors and protected by IP laws.
• No copying, distributing, modifying, reverse-engineering, or derivative works without written permission.
• All trademarks/logos are property of their owners; use doesn’t imply endorsement.

14) User Content; Reviews; License

• You represent you have rights to content you submit and that it doesn’t violate laws/rights.
• You grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, display, distribute, modify, and create derivative works from your content for lawful purposes in any media, without compensation.
• We may moderate/remove content at any time for lawful reasons.

15) Prohibited Activities

• Illegal use; rights violations; solicitation of illegal activity;
• Security interference, unauthorized access attempts;
• Bots/scrapers/automated access without permission;
• Misrepresentation; false information; IP/privacy infringements;
• Malware, spam, or harmful code.

16) Third-Party Services & Links

We may link to third-party sites/services (e.g., payment processors, suppliers). We aren’t responsible for their content or practices. Your use is at your own risk and subject to those parties’ terms and privacy policies.

17) DMCA Policy (Copyright Complaints)

Send claims to admin@thenecklife.com including: (a) description of the copyrighted work; (b) URL/location of the allegedly infringing material; (c) your contact info; (d) good-faith statement; (e) statement under penalty of perjury of accuracy/authority; and (f) your electronic signature.

18) Privacy & Cookies

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which explain our data practices and use of cookies/pixels.

19) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS/SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We don’t warrant uninterrupted or error-free operation or freedom from harmful components. Some jurisdictions limit disclaimers; where they do, this applies to the maximum extent permitted.

20) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NECK LIFE, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SPECIFIC PRODUCT(S) IN THE 6 MONTHS BEFORE THE EVENT. Some jurisdictions limit exclusions; where they do, this applies to the maximum extent permitted.

21) Indemnification

You agree to defend, indemnify, and hold harmless The Neck Life, LLC and its officers, directors, employees, agents, and affiliates from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of the Site/products, or violation of laws/rights.

22) Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ — THIS AFFECTS YOUR RIGHTS.

• Informal Resolution: Email admin@thenecklife.com with details; if unresolved in 30 days, either party may arbitrate.
• Binding Arbitration: AAA Consumer Arbitration Rules; single arbitrator; Florida seat/venue or remote; award final/binding.
• Class Waiver: Claims only on an individual basis; no class/representative actions; no consolidation.
• Small Claims & IP Relief: Individual small-claims actions in Florida allowed; injunctive relief for IP/unauthorized use allowed.
• Opt-Out: Email subject “Arbitration Opt-Out” to admin@thenecklife.com within 30 days of first use, with your name and account email.

23) Governing Law & Venue

Florida law governs (conflict-of-laws rules excluded), subject to the arbitration clause. For any permitted court proceedings, you consent to exclusive jurisdiction in Florida state and federal courts.

24) Export Controls; Sanctions

You aren’t in or from a sanctioned/embargoed country/region or on a restricted-party list, and you’ll comply with applicable export/sanctions laws.

25) Electronic Communications; E-Sign; Texts (If Used)

• You consent to electronic communications. Electronic agreements/notices satisfy “in writing” requirements.
• Marketing texts (if you opt in) follow the terms shown at opt-in; reply STOP to opt out, HELP for help. Consent isn’t a condition of purchase.

26) Termination

We may suspend or terminate access for any lawful reason. Sections that should survive (IP, disclaimers, limits, indemnities, disputes) do survive.

27) Force Majeure

We’re not liable for delays/failures due to causes beyond reasonable control (e.g., natural disasters, war, terrorism, labor actions, government acts, epidemics/pandemics, supply-chain or carrier failures, outages).

28) Assignment

You may not assign these Terms without our written consent; we may assign without restriction (e.g., merger, acquisition, asset sale).

29) Severability; No Waiver; Entire Agreement

If a provision is unenforceable, it’s enforced to the maximum lawful extent and the rest remains in effect. Our failure to enforce isn’t a waiver. These Terms plus incorporated policies are the entire agreement about the Site and products.
