1) Purpose & Scope
This Disclaimer explains important limits on the use of our Site, content, and products sold or featured by The Neck Life. It applies to all visitors and customers. This document works together with our Terms of Service, Privacy Policy, Return & Refund Policy, Shipping Policy, and Cookie Policy. If there is a conflict, the Terms of Service control.
2) No Professional Advice
Content on the Site—including articles, product pages, imagery, videos, emails, social posts, reviews, and Q&A—is for informational purposes only and is not medical, legal, safety, engineering, or professional advice. Do not rely on Site content as a substitute for consultation with licensed professionals (e.g., physicians, trainers, mechanics, electricians, guides). Always follow the product manufacturer’s instructions and warnings.
3) Product Use at Your Own Risk (Assumption of Risk)
Outdoor activity and gear use carry inherent risks (e.g., terrain, weather, wildlife, water, fire, tools, vehicles, electricity). By purchasing or using any product from us or our vendors, you voluntarily assume all risks associated with selection, installation, transport, storage, operation, maintenance, and disposal of the product. You are solely responsible for evaluating suitability for your intended purpose and for using appropriate caution, training, and protective equipment.
4) No Guarantee of Fitness for a Particular Purpose
Unless a product listing expressly states otherwise in writing from the manufacturer, products are offered “AS IS” and “AS AVAILABLE” with no warranty of fitness for a particular purpose. 5) Outdoor & Gear-Specific Safety Disclaimers
To reduce risk of injury, death, or property damage, read and follow all labels, manuals, and local laws. Without limiting the above:
- Personal Protective Equipment (PPE). Use appropriate PPE for the activity (helmets, gloves, eye/ear protection, PFDs/life jackets, heat-resistant gloves, etc.). Our lifestyle apparel is not life-safety gear.
- Climbing/Load-Bearing. Unless explicitly certified by the manufacturer for life-safety use, products (straps, cords, carabiners, hooks, rooftop racks, etc.) are not rated for climbing or human suspension. Respect working load limits (WLL) and vehicle manufacturer ratings. Inspect for wear; retire compromised gear immediately.
- Towing/Cargo/Vehicle Use. Verify hitch class, tongue weight, GVWR/GAWR, tie-down points, and cargo distribution. Re-check tension after the first miles and periodically. Off-road use increases loads and hazards.
- Cutting/Sharp Tools. Knives, axes, saws, and multi-tools are inherently dangerous. Keep away from children. Follow local knife/tool laws. Store sheathed; cut away from body; maintain sharpened edges responsibly.
- Heat/Fire/Combustion. Stoves, grills, fire-starters, and fuel accessories may cause burns, carbon-monoxide poisoning, or wildfires. Observe fire bans. Operate with ventilation. Keep extinguishers and water nearby. Cool fully before packing.
- Water/Boating/Cold Exposure. Water activities require approved PFDs and training. Many products are not life-saving devices. “Water-resistant” ≠ “waterproof.” Hypothermia risk exists even in mild weather.
- Electrical/Battery/Charging. Lithium cells, power banks, and chargers can overheat, ignite, or explode if damaged or misused. Use only compatible, certified chargers and cables. Do not short, puncture, crush, or expose to heat. Follow local transport rules for batteries.
- Fuel, Chemicals & Prop 65. Some items may contain chemicals known to the State of California to cause cancer or reproductive harm (Prop 65). Read product labels and follow handling instructions.
- Magnets & Small Parts. Strong magnets can interfere with pacemakers and cause injury if swallowed. Many accessories contain small parts—choking hazard for children and pets.
- Cold/Heat, UV & Weather. Materials can degrade due to UV, extreme temps, salt, and abrasion. Inspect before each use. Replace worn, cracked, or UV-damaged components.
- Food-Contact Items. If a product is intended for food contact, use only as directed. Cleaning agents and misuse can render items unsafe.
- Drones/Tracking/Comms. Observe aviation and privacy laws. Register or license devices if required.
- Emergency/First Aid. Survival or first-aid items are not a substitute for training or emergency services. In any emergency, call professional responders.
6) Installation, Alteration & Maintenance
Improper installation or modification voids warranties and increases risk. Unless you are qualified, seek professional installation (e.g., vehicle electrical, racks, gas systems, structural hardware). Use correct torque values, threadlocker where specified, and re-inspect fasteners periodically. Keep maintenance records.
7) Compatibility & Fitment
Colors, finishes, sizing, model years, trims, and regional variants can affect fit. Verify compatibility with the manufacturer or a qualified technician before purchase/use. We are not responsible for damage or loss caused by incompatible fitment, improper mounting, or overloading.
8) Third-Party Vendors, Specifications & Manuals
We are a reseller/dropshipper for multiple brands. Many specifications, certifications, images, and manuals are provided by manufacturers/suppliers and may change without notice. Packaging and components may vary by production run. Always consult the latest manufacturer materials included with the product or available on the manufacturer’s website.
9) User-Generated Content & Testimonials
Reviews, ratings, photos, endorsements, and testimonials reflect the views and experiences of individual users and are not verified or guaranteed. Results and performance vary widely and depend on conditions and skill. We may moderate or remove content at our discretion.
10) Colors, Dimensions & Tolerances
Product colors may appear differently due to lighting and display calibration. Dimensions, weights, and capacities may have reasonable manufacturing tolerances. Unless a listing states otherwise, such variances do not constitute defects.
11) No Guarantee of Results; Limited Remedy
We do not guarantee any specific performance, outcomes, or results (e.g., safety improvements, fuel savings, comfort, warmth, waterproofing, or durability) beyond the express written warranty (if any) provided by the product’s manufacturer. Your exclusive remedy is limited to the return/refund process described in our policies and any manufacturer warranty that may apply.
12) Limitation of Liability (Summary)
To the maximum extent permitted by law, The Neck Life, LLC and its officers, employees, agents, and affiliates are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for losses arising from injuries, death, property damage, loss of data, profits, or goodwill related to product selection, installation, use, or misuse—whether based in contract, tort, or otherwise—even if advised of the possibility. 13) Indemnification
You agree to defend, indemnify, and hold harmless The Neck Life, LLC from claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of our policies, violation of laws, or misuse/alteration of products. See the Terms of Service for details.
14) Recalls & Safety Notices
Manufacturers control safety notices and recalls. If we receive a notice affecting products we sold, we may attempt to contact affected customers when feasible. However, you are responsible for registering applicable products with the manufacturer and for monitoring recall and safety information.
15) Compliance with Laws; Age Restrictions; Export
You are responsible for complying with all applicable laws and regulations, including age restrictions (e.g., knives/tools), import/export rules, and local land-use or fire restrictions. Do not purchase restricted products for jurisdictions where possession or use is unlawful.
16) Third-Party Sites & Links
The Site may link to third-party websites or resources. We do not control and are not responsible for third-party content, instructions, or safety information. Use at your own risk.
17) Changes to this Disclaimer
We may update this Disclaimer from time to time. The latest version will be posted on this page with the Effective Date shown above. Updates apply prospectively.
18) Governing Law; Disputes
This Disclaimer is governed by the laws of the State of Florida, USA, without regard to conflicts principles and subject to the Dispute Resolution / Arbitration provisions in our Terms of Service.
